After a about a day of running the services we start getting these messages
out of nowhere...

-ChanServ- Sorry, the OP command is temporarily unavailable.
-ChanServ- Sorry, the INVITE command is temporarily unavailable.

same for deop, voice, devoice.. etc..

If we restart the services it works again for about a day...

We have tried running them on two separate box's. One running FreeBSD and
one running red hat. So it is definatly the services..
This was happening in 5.0.2 so we upgraded to 5.0.4 and its still happening.
