If the rest of the code is under GPL, that's not legal - he has to make
*all* source available to anyone he gives binaries to.  If he doesn't, he
doesn't have the right to distribute it at *all*, because of the GPLed
code.  If he is actually violating the license, I'd strongly advise
against using his software.  If he wants to sell an ircd, he has to write
it entirely himself, or start from something under a BSD-style license.
